En Maryland, cuando una pareja casada decide terminar su matrimonio por divorcio, los tribunales determinan la custodia de los hijos como parte del caso de divorcio. Para las parejas que no están casadas, cualquiera de los padres puede solicitar la custodia de los hijos siempre que se haya establecido la paternidad. En cualquier escenario, un tribunal puede otorgar tanto la custodia legal como la física a un padre.
La custodia legal implica el derecho de los padres a tomar decisiones importantes sobre la crianza, la educación, la religión y la atención médica del niño.
